State Significant Developments (SSD)

The NSW Government set up the Housing Delivery Authority (HDA) to speed up major housing projects. It aims to streamline approval processes, potentially bypassing local councils.

This is achieved by declaring developments as State Significant Developments (SSD). Some with a concurrent rezoning process.

The Department of Planning, Housing and Infrastructure (DPHI) undertakes the merit assessment of all SSDs and concurrent rezonings. This means the application is assessed and determined by the NSW Government rather than Council. 

Council and the community can comment during the 14-day public exhibition period. SSDs are generally determined by the DPHI within an average of 275 days. 

The HDA to SSD process generally works as follows: 

  1. An applicant submits an Expression of Interest to the HDA seeking consideration under the HDA pathway.  

  2. If the HDA considers the proposal suitable, it may recommend that the project be declared as SSD, sometimes with a concurrent rezoning. The HDA does not approve development applications. 

  3. The Minister for Planning (or delegate) decides whether to declare the proposal as SSD. If declared SSD, the project enters the State assessment pathway. 

  4. DPHI manages the assessment process, including setting assessment requirements, publicly exhibiting the application, reviewing submissions and undertaking the technical assessment. 

  5. During public exhibition, Council, government agencies and community members can make submissions on the proposal. Council’s role is to provide advice to DPHI on matters such as local planning controls, site context, infrastructure needs and community impacts. Council is not the consent authority and does not determine the application. 

  6. Following assessment, the Minister for Planning (or delegate) determines whether the SSD application is approved or refused, and may impose conditions of consent if approved.
